Terms of business

The short version: clear scope, fair payment terms, and you own what you pay for.

These terms apply to projects carried out by Pixelyte unless a separate written agreement says otherwise. A project begins when you accept a written proposal and pay any deposit requested.

Quotes and scope

Every project is quoted in writing with a defined scope. The quote is valid for 30 days. If the scope changes, we will agree any change to cost and timing in writing before carrying out the extra work.

Payment

Unless the proposal says otherwise, projects are split into a 50% deposit before work begins and the balance before launch. Retainers are billed monthly in advance. Invoices are due within 14 days. We may pause work on overdue accounts.

What you provide

You agree to provide content, brand assets, access and feedback within reasonable timeframes. Delays in these can move the launch date. You confirm you have the right to use anything you send us.

Revisions

Each project includes the number of revision rounds set out in the proposal. Further rounds are charged at our standard day rate, agreed in advance.

Intellectual property

On final payment, you own the design and code created specifically for you, along with your content and domain. We retain the right to show the work in our portfolio unless you ask us not to. Third-party software and fonts remain subject to their own licences.

Hosting and maintenance

Hosting and maintenance are not included unless stated in the proposal. Care plans are rolling monthly and can be cancelled with 30 days' notice. We are not responsible for outages caused by third-party providers, but we will help resolve them.

Liability

We will carry out the work with reasonable skill and care. We are not liable for indirect or consequential loss, or for loss of profit or data. Our total liability is limited to the fees paid for the project.

Ending the agreement

Either party may end the agreement with 14 days' written notice. You remain responsible for work carried out and costs committed up to that point.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
